Agency licensure program

The licensing of Emergency Medical Services and Fire Department Rapid Response is regulated by Legislative Rule 64 CSR 48, WV Code 16-4C, and the WVOEMS Policies and Procedures. Any entity intending to provide Emergency Medical Services must be licensed before doing so.

Rapid Response Fire Departments: Affiliated Agreements: A Rapid Response Fire Department is defined as a department certified by the West Virginia State Fire Commission that provides basic life support services that does not charge a fee for its medical services OR transport of patients. These departments shall obtain either one of the following:

  1. May elect to obtain an EMS licensure in accordance with Legislative Rule 64CSR48-4.5.9.b.1 free of charge for both agency and vehicle inspection or;
  2. Obtain a Affiliated Agreement with an EMS Agency licensed by OEMS that addresses medical direction, training, quality assurance, and liability insurance in accordance with Legislative Rule 64CSR48-4.5.9.c. The EMS Agency will be required to list and provide contracts of all Affiliated Agreements within their Agency Application. These Rapid Response Fire Departments are still subject to OEMS inspections at anytime for both agency and vehicle compliance in accordance with Legislative Rule 64CSR48-4.10.4.b

Definitions

  • EMS Agency - An entity that intends to provide emergency medical services under the guidance of a WVOEMS approved Medical Director, that intends to transport patients to and from medical facilities in accordance with 64 CSR 48-4.
  • Transporting Fire Department - An entity that intends to provide emergency medical services under the guidance of a WVOEMS approved Medical Director, that intends to transport patients to and from medical facilities in accordance with 64 CSR 48-4.5.9.a
  • Fire Department Rapid Response - An entity that intends to provide on-scene EMS support but does not provide patient transport to and from medical facilities in accordance with 64 CSR 48-4.5.9.b

Becoming a licensed agency

EMS licenses shall be issued for any combination of the following EMS services:

  • Fire department rapid response-basic life support.
  • Fire department rapid response-advanced life support.
  • Rapid response-basic life support.
  • Rapid response-advanced life support.
  • Basic life support.
  • Advanced life support.
  • Critical care transport (CCT).
  • Rotary wing transport.
  • Fixed wing transport.
